Received a reply today from Scottish Power. They are apparently sorry that I feel the need to seek legal advice, but wish to advise me that they intend to fight me in the courts. I should expect no less!! They also tell me that should a court find in their favour, I will incur legal fees. Well bugger me - I never thought on that!! And they finish by saying that they stiil intend to pursue the remaining outstanding balance through their debt collection service.
My response is - bring it on. The other side of the coin is that a court finds in my favour, and then who incurs legal expenses. As for the remaining outstanding balance - if the court finds in my favour I stand to receive a large sum of money I have already overpaid, plus I'll aim for maximum compensation for the stress and anguish this has caused over the years. Am I confident I'll win - the simple answer is no, but I believe I have enough evidence to prove my case. Obviously I will be guided by my solicitor once he gets back to me.
